The BackGames.org
Backgammon Club Database System is an online resource for
backgammon club directors to manage tournament data, player
standings and statistics, and other related club information.
Please read this
agreement carefully before using the database program.
Acceptance
of Terms
By using the BackGames.org
database program, you agree to be bound by the terms and
conditions of this agreement. If you do not accept these
terms, do not use the program.
BackGames.org
reserves the right to modify, add, or remove portions of
these terms and conditions at any time. Unless specified
otherwise, such modifications shall be effective immediately
upon posting of the modified agreement to the website.
Your continued use of the program following the posting
will mean that you accept those changes.
Description
of Services
The database program
is accessed online through a web browser. You enter your
club information, player information, and tournament results
which are then stored in a common database on the BackGames.org
server. When club data has been added to the database,
club standings, player statistics, and other club information
can be viewed as web pages on the internet. These pages
can then be linked from your club website.
BackGames.org
reserves the right to enhance, modify, add, or discontinue
any of the services provided at any time without advance
notice.
Director
Registration
Backgammon club
and tournament directors who use the program must personally
provide accurate, current, and complete information when
requested on any club information or registration forms.
Registered users will receive login and password access
to the database program. Users can change their login and
password at any time and are personally responsible for
the confidentiality of passwords. If you suspect someone
else has unauthorized access to your club account, you
should change your login and password immediately.
Acceptable
Use
The database program
is intended for use by bona fide backgammon club or tournament
directors to manage actual player and tournament data.
Any attempt to skew standings or statistics with bogus
player or tournament data, or to use the program for any
reason other than the intended, will be considered a violation
of acceptable use. Any such violation will result in the
immediate termination of user access to the program and
any offending data will be purged from the database.
Privacy
Policy
BackGames.org
will not sell, share, or rent any personal information
contained in the database. Personal player information
(address, email, phone numbers) will be accessible only
to the director who entered the data. The only player data
that is shared between directors is the player's name,
city, state, country, and home club.
Other club information
including the director's name, email address, club venues,
meeting times, etc., may be made available to the backgammon
community in an online club directory on the BackGames.org
site.
When you login
to the database program, browser cookies are stored on
your computer to insure that access to the database is
restricted to the user who logged in. Cookies are not used
for any other purpose, nefarious or otherwise. You must
enable cookies in your browser in order to login to the
program.
Data Storage
and Backup
While BackGames.org
will use reasonable efforts to back up the site and program
data at regular intervals and make such data available
in the event of loss or deletion, BackGames.org assumes
no responsibility or liability for the deletion or loss
of any user data. If the database integrity is found to
be corrupted, a reasonable attempt will be made to restore
the database to the most recent backup and the status will
be posted on the BackGames.org site.
Termination
BackGames.org
may terminate a user's access to site resources for any
reason or no reason at all. Actions which will result in
termination may include, but are not limited to, the following:
(1) violation of these terms; (2) abuse of site resources
or an attempt to gain unauthorized entry to site resources;
(3) a user's request for termination; (4) as required by
law, government regulation, or court order.

and Limitations of Liability
USE
OF THE BACKGAMES.ORG SITE AND SERVICES IS AT THE USER'S
SOLE RISK. THE DATABASE AND THE SUPPORTING SOFTWARE PROGRAM
ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS,
WITHOUT WARRANTY OF ANY KIND. BACKGAMES.ORG ASSUMES NO
RESPONSIBILITY FOR THE TIMELINESS, DELETION, MIS-DELIVERY
OR FAILURE TO STORE ANY USER DATA TRANSMITTED BETWEEN THE
USER AND THE SITE. OPERATION OF THE BACKGAMES.ORG SITE
MAY BE SUBJECT TO INTERFERENCE FROM NUMEROUS FACTORS OUTSIDE
OUR CONTROL. FURTHER, SCHEDULED AND PREVENTIVE MAINTENANCE
AS WELL AS EMERGENCY MAINTENANCE WORK MAY TEMPORARILY INTERRUPT
ACCESS TO THE WEBSITE. BACKGAMES.ORG DISCLAIMS ANY EXPRESS
OR IMPLIED CONDITIONS, REPRESENTATIONS AND WARRANTIES OF
ANY KIND, INCLUDING ANY IMPLIED WARRANTY OR CONDITION OF
MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE OR NONINFRINGEMENT.
SPECIFICALLY, BACKGAMES.ORG MAKES NO WARRANTY THAT (1)
THE BACKGAMES.ORG SITE OR ANY SERVICE THEREON WILL MEET
ANY USER'S REQUIREMENTS OR EXPECTATIONS, (2) USER ACCESS
WILL BE UNINTERRUPTED, TIMELY, SECURE OR ERROR-FREE, AND
(3) ANY ERRORS IN THE DATABASE OR SOFTWARE WILL BE CORRECTED.
TO THE EXTENT NOT PROHIBITED BY LAW, BACKGAMES.ORG IS NOT
LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, PUNITIVE,
OR CONSEQUENTIAL DAMAGES OF ANY KIND WHATSOEVER WITH RESPECT
TO THE SERVICE, THE CONTENT, OR THE USER DATA. THE DISCLAIMERS
OF WARRANTY AND LIMITATIONS OF LIABILITY APPLY, WITHOUT
LIMITATION, TO ANY DAMAGES CAUSED BY THE FAILURE OF PERFORMANCE,
LOSS OF DATA, DELAY IN OPERATION OR TRANSMISSION, COMPUTER
VIRUS, COMMUNICATION LINE FAILURE, THEFT OR DESTRUCTION
OR UNAUTHORIZED ACCESS TO, ALTERATION OF OR USE OF ANY
ASSET, WHETHER ARISING OUT OF TORTIOUS BEHAVIOUR, NEGLIGENCE
OR ANY OTHER COURSE OF ACTION BY BACKGAMES.ORG.
